Welcome to Best Aussiedoodles! These Terms and Conditions govern your access to and use of our website (www.bestaussiedoodles.com) and any services provided by Crockett Doodles. By using our website or purchasing a puppy from us, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using our website, you agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree with any part of these terms, you must not use our website or services.

2. Eligibility

To use our website and purchase a puppy, you must be at least 18 years old and legally capable of entering into binding contracts. By placing an order, you confirm that you meet these requirements. If you are purchasing a puppy on behalf of another person or entity, you warrant that you have the authority to do so and that the recipient agrees to these terms.

3. Puppy Availability

Stock Changes: The availability of puppies listed on our website is subject to change without notice. We strive to keep our listings current, but we cannot guarantee that a particular puppy will be available at the time of your inquiry or purchase.
Reservation of Rights: Crockett Doodles reserves the right to refuse or cancel any order for any reason, including but not limited to, the unavailability of a puppy, errors in pricing, or suspected fraudulent activity.

4. Health Guarantee

Initial Health Examination: We guarantee that each puppy is in good health to the best of our knowledge at the time of sale. Our puppies have been checked by a licensed veterinarian. In the case of any potential health issue found by the veterinarian, this is fully disclosed to the buyer prior to sale and the buyer is able to choose to opt out of the sale without penalty.
Vet Examination Requirement: The buyer is required to have the puppy examined by a licensed veterinarian within 7 days of taking ownership of the puppy. Failure to do so will void any Health Guarantee provided by Crockett Doodles.
Reporting Health Concerns: If your veterinarian identifies any health concerns within the 7-day period after taking ownership of the puppy, you must report it to us immediately. You will be required to provide documentation from your veterinarian to qualify for the terms and conditions set in our Health Guarantee.

5. Payment Terms

Payment Methods: We accept cash, cashier’s/certified check, major credit cards, PayPal, and Zelle payments. All puppy purchase price balance payments must be made in full before a puppy is released to the buyer on Adoption Day. Payments for delivery and/or training services must be paid in full before said service is rendered.
Payment Plans: We do not currently offer payment plans. The balance of the puppy and any services such as training and delivery are due in full upon request.
Deposit: A deposit refundable for up to 2 years (minus a 9% processing fee) is required to purchase a puppy. This deposit will be applied to the total purchase price.

6. Pricing and Taxes

Prices: All prices listed on our website are in USD and are subject to change without notice. The price you pay for a puppy will be the price listed at the time you place your order.
Taxes: You are responsible for any applicable taxes, duties, or fees associated with your purchase. These may vary based on your location.

7. Shipping and Delivery

Shipping Methods: We offer several options for the delivery of your puppy, including in-person pick-up at your puppy’s home, Ground Delivery by driver, and Flight Nanny by air. Delivery costs will be added to the total purchase price and must be paid in advance of the service.
Delivery Safety: We take every precaution to ensure the safe transport of our puppies with professional and caring individuals. However, we are not responsible for any injuries, illness, or stress that may occur during delivery outside of our control in events categorized as force majeure or acts of God.
Delivery Time: Estimated delivery times are provided for your convenience and are not guaranteed. We will do our best to ensure clear communication during travel and timely delivery but cannot be held responsible for delays beyond our control such as flight cancellations, construction, inclement weather or traffic issues.

8. Returns and Refunds

No Returns Policy: Due to the nature of our business and the welfare of our puppies, all sales are final. We do not offer refunds or accept returns outside of the limits set in our Health Guarantee once a puppy has been sold and the buyer has taken ownership.
Customer Satisfaction: While we do not offer refunds outside of the limits of our Health Guarantee, we are committed to ensuring that you are happy with your purchase. If you have any concerns please contact us, and we will work with you to address them within the limits of our Health Guarantee.
Rehoming Assistance: If you find that you are unable to care for your puppy after purchase, please contact us to inquire about our ReHome Service offered to Crockett Doodles’ original owners. We may be able to offer you access to this service, but no refund will be provided outside the limits of our Health Guarantee.

9. Limitation of Liability

No Guarantee of Specific Results: Crockett Doodles does not guarantee that the puppy will meet your expectations or fit a specific description. While we strive to match each puppy with the right owner, we cannot guarantee the behavior, temperament, or suitability of any puppy for your particular needs. Puppies are living beings and unique. We give general estimations and descriptions based on our personal observations of our puppies but do not make guarantees as to personality, final growth size, or temperament suitability for your home.
Limited Liability: To the fullest extent permitted by law, Crockett Doodles shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your purchase of a puppy, including but not limited to loss of profits, emotional distress, or veterinary expenses. Our liability is strictly limited to the purchase price of the puppy within the limits and terms of our Health Guarantee the buyer agreed upon when applying to purchase a puppy.

10. Intellectual Property

Ownership of Content: All content on our website, including but not limited to text, images, graphics, logos, and videos, is the exclusive property of Crockett Doodles and is protected by copyright and other intellectual property laws.
Restrictions on Use: You may not reproduce, distribute, modify, or create derivative works from any content on our website without our express written permission. Unauthorized use of our content may result in legal action.

11. Privacy Policy

Data Collection: We collect personal information that you provide to us during the purchase process, such as your name, address, email, and payment details. This information is used to process your order and communicate with you.
Data Security: We take reasonable measures to protect your personal data from unauthorized access, loss, or misuse. However, no data transmission over the internet can be guaranteed to be 100% secure.

12. Governing Law and Dispute Resolution

Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the state of South Carolina, United States, without regard to its conflict of law principles.
Dispute Resolution: Any disputes arising out of or in connection with these Terms and Conditions or your purchase of a puppy shall be resolved through good faith negotiations. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in South Carolina. The decision of the arbitrator shall be final and binding on both parties.

13. Force Majeure

Crockett Doodles shall not be liable for any failure to perform its obligations under these Terms and Conditions if such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of war, or government actions.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms and Conditions, along with our Privacy Policy and the Health Guarantee terms under which you purchased your puppy, constitute the entire agreement between you and Crockett Doodles concerning the purchase of a puppy. Any prior agreements, representations, or understandings, whether written or oral, are superseded by these terms.

16. Changes to Terms and Conditions

We reserve the right to update, modify, or amend these Terms and Conditions at any time. Any changes will be posted on this page, and the “Last Updated” date will be revised accordingly. It is your responsibility to review these terms periodically. Continued use of our website or services after any changes constitutes your acceptance of the new terms. This excludes any changes or updates made to our Health Guarantee. Buyer is subject to the conditions of the Health Guarantee version under which they purchased their puppy.
